Terms of Service

1. Scope
These Terms of Service govern the use of the GalaCube platform ("Platform"), operated by Restless UG (haftungsbeschränkt), Luca von Oesen ("we", "us"). The Platform connects customers seeking event services ("Customers") with event service providers ("Providers").
2. Service Description
GalaCube is a digital event concierge. We receive event requests, check availability with suitable providers, and present Customers with a curated selection of options. The actual booking and payment occur directly between Customer and Provider.
3. Free for Customers
Use of the Platform is free for Customers. No brokerage fees or hidden costs apply. The Platform is funded through commissions paid by Providers.
4. Commission Model (Providers)
Providers pay a commission to GalaCube upon confirmed booking. The commission rate is specified in the individual Provider agreement. Invoicing is handled via Stripe.
5. Contractual Relationships
GalaCube acts as a mediator, not as a contracting party for the event service. The service contract is formed exclusively between Customer and Provider. GalaCube is not liable for the performance of contracts between Customer and Provider.
6. User Obligations
Users agree to provide truthful information in their event requests. Sharing login credentials with third parties is prohibited. Users may not use the Platform for unlawful purposes.
7. Limitation of Liability
GalaCube is liable only for damages arising from the breach of material contractual obligations (cardinal obligations) and in cases of intent or gross negligence. Liability is limited to foreseeable, typically occurring damages. This limitation does not apply to damages resulting from injury to life, body, or health.
8. Data Protection
The collection and processing of personal data is governed by our Privacy Policy.
9. Amendments
We may amend these Terms of Service. We will notify you of material changes by email at least 30 days before they take effect. If you do not object within 30 days of notification, the updated terms apply. You may terminate your use of the Platform at any time.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer within the EU, you also benefit from any mandatory provisions of the law of your country of residence. The place of jurisdiction is Hamburg, Germany, insofar as legally permissible.
11. Severability
If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect.
